- The owner of a going concern entrusts its operation to a free manager, who runs it at their own risk for a royalty. Ownership of the business is not transferred. In Morocco it is governed by articles 152 to 158 of the Commercial Code.
- How does it differ from buying a business?
- With a management lease you rent the operation (monthly royalty) without buying the business: less capital, more flexibility. When buying (assignment) you become owner of the going concern (customers, lease, licence). A commercial lease, by contrast, covers only the walls.
