Business and real estate brokerage
Capital Parc is a real estate brokerage operating in Marrakech and its region (Guéliz, Hivernage, Palmeraie, Route de l'Ourika, Route de Fès, Amelkis, Targa, the medina, etc.). It assists sellers, landlords, buyers and tenants in sales, long-term rentals, seasonal rentals, management leases (location-gérance) and the transfer of business goodwill.
The agency acts as an agent (mandataire) on the basis of mandates entrusted by owners or their representatives. The nature of the service, the agency fees and the terms of the assignment are set out in a separate agreement (mandate, viewing voucher, assignment order) concluded directly with the client concerned. Listings published on the site do not constitute a mandate and grant the visitor no exclusivity.
Agency fees
Unless otherwise agreed, Capital Parc's brokerage fees amount to 3% incl. tax of the sale price for a sale transaction, and one (1) month's rent excl. tax for a letting. These fees are due upon completion of the operation and are set out in the mandate or viewing voucher signed with the client.
Fees are additional to the displayed price and are separate from registration duties, notary and land-registry fees, which remain payable by the parties under applicable regulations.
Nature of listings and information
Real estate listings are published for information purposes only and do not constitute a contractual offer within the meaning of the Moroccan Code of Obligations and Contracts. Unless expressly stated, prices are expressed in Moroccan dirhams (MAD) and exclude agency fees, registration and land-registry duties, notary fees and applicable taxes.
Areas (living, built, land) are provided for guidance based on details supplied by the owner and must be verified before any commitment. The legal status of the property (land title, registration request, undivided ownership or melkia) must be confirmed with the notary and the Land Registry (Conservation foncière).
For off-plan sales (VEFA), the contractual relationship is governed by Law no. 44-00 on the sale of buildings under construction. Availability, prices and features may change at any time without notice.
Intellectual property
All site content (text, photographs, plans, visuals, logos, the “Capital Parc” name, visual identity, structure and code) is protected by copyright and trademark law. Property photographs are owned by K P Services or its principals and may not be reproduced, indexed or reused without prior written authorisation.
Any reproduction, representation, extraction or distribution, in whole or in part, without authorisation is prohibited and constitutes infringement giving rise to civil and criminal liability.
Liability
